Terms of use
Effective 20 October 2026
These terms apply to the SmartMeal AI app for iOS and Android and the service behind it. By creating an account you accept them. If you do not agree, please do not use the app.
1. Who provides the app
SmartMeal AI is provided by Mikołaj Matejko, a sole trader, ul. Meteorologów 23/24, 40-526 Katowice, Poland, tax ID (NIP) 6462955044 ("we"). Contact: privacy@smartmealai.com.
2. What the app does
SmartMeal AI recognises food in your photos, suggests recipes from what you have or what you describe, keeps your recipes and shopping lists (also offline and shared with people you invite) and helps you cook step by step. Recognition and recipes are made by an artificial intelligence (AI) model.
3. AI makes mistakes: check before you cook
- Recognised ingredients, recipes, amounts, cooking times and nutrition values are generated by AI. They can be wrong, incomplete or unsuitable for you. Nutrition values are estimates.
- Allergies and diets: the app tries to avoid what you list, but it cannot guarantee that a recipe is free of an allergen or fits a diet. Always check the labels of every product and each ingredient yourself.
- Follow ordinary food safety: cook meat, fish and eggs through, keep food at safe temperatures, do not eat what looks or smells spoiled.
- The app is not medical or dietary advice. If you have a medical condition, a severe allergy, or are pregnant, ask a doctor or dietitian.
4. Your account
- You must be at least 16 years old to use the app.
- You sign in with Apple or with email and password. Keep your sign-in safe; what is done with your account is your responsibility.
- You can delete your account at any time in Profile → Delete account. What happens to your data then is described in the privacy policy.
5. Free and Premium
- The free plan includes a monthly number of photo analyses and recipe suggestions, shown in the app. Typing ingredients, lists, favourites and your own recipes have no limit.
- Premium is a subscription with higher monthly limits, bought in the App Store or Google Play, monthly or yearly. The price is shown in the store before you buy.
- The subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. You manage and cancel it in your App Store or Google Play account settings; deleting the app or your account does not cancel it.
- Payments and refunds are handled by Apple or Google under their terms. Your statutory consumer rights are not affected.
- Limits count per calendar month and reset on the first day of the month. We may change the limits or the features of the plans; a change that reduces a paid subscription takes effect from the next period, and we tell you in advance.
6. Using the app fairly
You agree not to:
- use the app against the law or to upload content that is illegal or infringes others' rights;
- photograph or share other people without their consent;
- access the service other than through the app (scripts, bots, scraping), get round the limits, or disturb the service or other users;
- copy, resell or reverse-engineer the app, except as the law allows.
We may suspend or close an account that seriously or repeatedly breaks these rules, after a warning where possible.
7. Your content and sharing
- What you type, your photos, lists and your own recipes stay yours. You let us store and process them only to run the app for you and the people you share with.
- A shared list is visible to its members, and its invite link shows the list to anyone who has the link until you turn it off. A shared recipe can be opened by anyone with its link. Share links only with people you trust.
- Recipes generated for you may be used by you freely for your own cooking. Dish photos come from Unsplash under the Unsplash licence and are credited in the app.
8. Availability
We work to keep the service running, but it may be unavailable at times (maintenance, failures, the AI provider). Lists you opened before keep working offline. We may change or end features; if we end the whole service we will tell you at least 30 days before, and refund unused paid periods where the store allows it.
9. Liability
We are liable under the law that applies to you, but not for damage caused by relying on AI output without the checks described in section 3, by events beyond our control, or by your breach of these terms. Nothing in these terms limits liability that cannot be limited by law, in particular for intent, gross negligence or injury to health or life, or your rights as a consumer.
10. App Store and Google Play
If you got the app from the Apple App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your licence is to use the app on Apple-branded devices you own or control, as the App Store Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the app.
- If the app does not conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that it does not meet legal or regulatory requirements, consumer protection, privacy and intellectual property claims.
- You confirm that you are not in a country under a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
- You must also comply with any third-party terms that apply to you when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got the app from Google Play, the Google Play Terms of Service also apply to the purchase.
11. Changes and law
- We may update these terms, for example when the app changes. We will publish the new version here and tell you in the app at least 14 days before a change that matters to you takes effect. If you do not agree, you can delete your account and cancel the subscription.
- Polish law applies. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim before the courts there.
- Questions and complaints: privacy@smartmealai.com. We answer within 14 days.
